The Beiseker Municipal Board enacts the following by-laws pursuant to the Libraries Act.
Interpretation 1. For the purpose of this by- law the expression: A) Act refers to the Libraries Act B) Board means the Beiseker Municipal Board. C) Borrower means the person to whom a library membership card has been issued. D) Librarian means the person charged by the board with the operation of the Beiseker Municipal Library. E) Library materials means print and non-print materials intended for cultural, educational, and informational use for loan in the collection of the Beiseker Municipal Library or borrowed by the Beiseker Municipal Library. F) Policy Manual means the Policy Manual of the Beiseker Municipal Library as adopted October 22, 2007, by the Beiseker Municipal Library Board.
Library Facility 1. The library is open to any member of the public FREE OF CHARGE during the hours of opening as set out by the Beiseker Municipal Library Board. 2. Any person using the library facility shall conduct himself so as to not disturb other library users.
1. Any person resident in the Village of Beiseker, surrounding county area, or Marigold Library System is eligible to apply for a Library Card. 2. A request for a Library Card shall be accompanied by the fee prescribed in Schedule A. 3. The librarian shall issue a Library Card to a person who is eligible pursuant to the above.
Responsibilities of a Member 1. A Library Card may only be used by the person to whom it has been issued or by an immediate family member. 2. A member shall notify the librarian of any change of address and/or telephone number. 3. A member should take proper care of any library item entrusted to his care. 4. A member should return any library item to the library on or before the due date as stated in Section XIV. LOANS AND LOAN PERIOD POLICY of the Policy Manual
Loan of Materials 1. In accordance with the Libraries Act there shall be NO CHARGE for the use of library materials. This includes materials used on the premises, materials loaned or materials acquired from other services at the discretion of the board. 2. The loan periods for various for Library materials are set out in the Policy Manual. 3. Library materials may be reserved in accordance with Marigold and TRAC procedures as set out in the Policy Manual. 4. Library materials may be renewed in accordance with Marigold and TRAC procedures as set out in the Policy Manual.
Penalty Provisions 1. The fines for late return of materials are as set out in Section X. OVERDUE BOOK POLICY of the Policy Manual. 2. The fines for damaged or lost materials are as set out in Section XI. LOST BOOK POLICY of the Policy Manual, and Marigold headquarters is notified so materials can be replaced. 3. The procedures for demanding the return of overdue materials are as set out in Section X. OVERDUE BOOK POLICY of the Policy Manual. 4. A Library Card may be revoked by the librarian for the reasons as set out in Section IX. LIBRARY LENDING POLICY of the Policy Manual. 5. A person who has had his membership revoked may, within 30 DAYS of such revocation, make an appeal to the board in writing setting out the grounds of the appeal. 6. The decision of the board in an appeal is final and not subject to further appeal. 7. In cases of serious dereliction, the board may prosecute an offence under the Libraries Act.
Freedom of Information and Protection of Privacy 1. The Beiseker Municipal Library has agreed to implement the Village of Beisekers Bylaw 99-15, as stated in Section XXVI. FREEDOM OF INFORMATION AND PROTECTION OF PRIVACY ACT of the Policy Manual.
SCHEDULE A: Membership Card Fees 1. The library shall charge a Library Card administration fee to all persons wishing to join the Beiseker Municipal Library, with the exception of a person holding a valid membership in another library within The Alberta Library, or TRAC - that person shall receive a membership at no cost. 2. A Library Card shall be issued to each borrower. It shall be valid for one year from date of issue and shall indicate the expiry date. 3. Memberships shall be valid for one year from the date of issue or to that point in time it is revoked by the librarian for cause (see Schedule E – Revoking of Memberships). 4. The membership fee structure of the Beiseker Municipal Library shall be as follows:
Family membership Non-Residence membership Seniors Groups (Play-school, church, etc.)
1. Book Loan Period: Books may be kept for THREE WEEKS, according to the Dynix default. 2. Audio Visual Material Loan Period: Material may be kept for THREE WEEKS.
SCHEDULE C: Penalty Provisions 1. Books and Audio Visual items not returned within three weeks are considered to be overdue books. Patrons shall be notified by telephone where possible and by mail if necessary. Fines shall be assessed according to Section X. OVERDUE BOOK POLICY of the Policy Manual. 2. Books and Audio Visual items not returned within nine weeks are considered to be lost books. Patrons shall be notified by telephone where possible and by mail if necessary. Fines shall be assessed according to the Policy Manual. 3. Books and Audio Visual items returned damaged or soiled beyond repair will be treated the same as lost books, as stated in the Policy Manual. The librarians decision as to what constitutes unreasonable soiling or damage will be final.
SCHEDULE D: Expired Memberships 1. Patrons will have three weeks of grace from the date of expiry before their Library privileges will be cancelled. 2. A patron will not be allowed to borrow beyond the four-week grace period unless the membership is renewed.
SCHEDULE E: REVOCATION OF MEMBERSHIP CARDS The librarian shall revoke the membership of any patron when the patron has: -failed to pay overdue Library fines in excess of $10.00 (to be initiated when a drop box has be installed); -failed to pay for damaged or lost items entrusted to his/her care within two weeks of the final letter mailing giving such notice; -failed to return Library items as requested by the librarian.
Patrons guilty of said offences listed above shall have their names placed on a restricted list and borrowing privileges shall be cancelled until such time as all overdue fines are paid, damaged or lost items are paid for, or library items previously withheld are returned. This policy shall be strictly enforced. In such a case where legal action may be required, the matter will be brought before the board for review, once approval has been given; the appropriate steps will be taken.
When the librarian has revoked a membership, the patron, or where the patron is a junior member, his/her parent or guardian may, within 30 days of such revocation, make an appeal to the Board in writing against the revocation, being sure to set out the grounds of the appeal.
The librarian shall bring the appeal before the Board. The decision of the Board in an appeal pursuant to Section B (3) is final and not subject to further appeal.
